Apple Pty Ltd, or any of its affiliates or subsidiaries (collectively, “Apple”) provides this recycling and reuse service (the “Service”) at no cost to its customers. To the extent permitted by applicable law, Apple hereby disclaims and excludes any and all warranties of any kind, express or implied related to the Service.

Apple is providing the Service only for Apple or non-Apple branded electronic devices that are of the same type sold by Apple (i.e. devices that contain microchips or circuit boards and are designed and commonly used for personal, household or business use together with accessories that are used with such devices) (“Devices”). The following items (including their components and accessories) are ineligible as Devices under the Service: appliances, motor vehicles and other mobility devices, medical devices (other than monitoring devices), and devices regarded as hazardous waste, or with substantial contamination or liquid content including those that ordinarily would be expected to come into contact with bodily fluids. Apple reserves the right to reject any Device, including based on its nature or condition.

Customer represents and warrants that it has the lawful right to allow Apple or its designee to perform the Service. Customer represents that customer is providing to Apple only Device(s) that are owned by customer, and that if someone is sending or bringing a Device in on customer’s behalf, they are authorized to do so. If customer is not the owner of the Devices, customer represents that customer has been authorized by such owner to bring in the Device(s) under the Service.

Customer acknowledges that participation in this Service constitutes acceptance of these Terms and Conditions. Once customer accepts these Terms and Conditions and/or delivers or otherwise hands over the Device(s) for the Service, customer transfers title in such Device(s) to Apple and disclaims any further right, title or interest in and to the Device(s) or any data contained therein.

If the Device is being brought to an Apple Retail store for the Service, customer represents that customer is a resident of the Country in which the Device is being brought for the Service.

Apple cannot, and does not guarantee, that it will be able to honor any request for return of the Device. Customer agrees that it has the sole responsibility to keep a separate back up copy of any files or data, and delete Customer data, before transferring ownership of the Device to Apple. Data recovery is not a part of the Service and Apple accepts no responsibility or liability for any lost files or data.

Any items given to Apple as part of this Service must not violate any applicable laws, including export laws and customer represents and warrants that it has and shall comply with any and all such laws. Customer represents and warrants that any items provided to Apple as part of the Service shall not: (1) infringe on any third-party intellectual property right (including copyright, trademarks, patent, trade secrets or other proprietary right) or (2) be counterfeit, stolen, or fraudulent.

This Service is provided for lawful purposes only, and the Customer agrees to indemnify Apple and any of its directors, officers, employees, affiliates, subsidiaries or agents from and against any claims brought against any of them arising from performing this Service on customer’s behalf or for any breach of these terms and conditions by customer.

Apple and its affiliates, employees and agents will under no circumstances be liable for any special, indirect, incidental or consequential damages resulting from this Service, to the extent permitted by applicable law.

To the extent permitted by applicable law, Apple’s entire liability, if any, from any cause whatsoever with respect to this Service shall not exceed $20.

This offer is void where prohibited or restricted by law.

Apple reserves the right to change these terms and conditions or to cancel this Service at any time without notice.

This Service is not redeemable and has no cash value.
